The project scope, deliverables, price, timeline and payment terms should be confirmed in writing. If a signed proposal, invoice, statement of work or other written agreement conflicts with these general terms, the project-specific written agreement takes precedence.
1. Scope & deliverables
Each project is based on an agreed scope. Depending on the package, this may include website design and development, responsive implementation, content placement, social media services, maintenance or related digital work.
Only the deliverables expressly included in the agreed proposal or package are included. New pages, features, integrations, content production, campaigns or other work outside that scope may require a revised estimate.
2. Pricing & payment
Pricing is based on the selected package or written quotation. Unless a different arrangement is agreed in writing, our standard website payment structure is 50% advance and 50% on completion.
Work may begin after the required advance is received. Final files, launch or transfer of project assets may be subject to settlement of outstanding amounts, where applicable.
Third-party charges such as domain registration, hosting, paid plugins, stock assets, advertising spend, payment gateway fees or external software subscriptions are not automatically included unless explicitly stated.
3. Revisions, approvals & changes
The number of revisions included in a package is determined by the agreed scope. Revision requests should be consolidated where practical so that work can move efficiently.
Once a design, page or deliverable has been approved, substantial changes to an already-approved direction may be treated as additional work. Requests outside scope may require an additional quote before implementation.
4. Client responsibilities
The client is responsible for supplying accurate business information, logos, images, copy, pricing, contact details, approvals and other required materials unless content creation is explicitly included in the project.
The client must have the right to use materials supplied to Web Zesta. Web Zesta is not responsible for infringement arising from client-supplied material that the client does not have permission to use.
Delays in receiving content, approvals, credentials or decisions can affect the agreed timeline.
5. Content & accuracy
Clients are responsible for reviewing business information, prices, contact details, legal text and other factual content before launch. Web Zesta can implement approved content, but the client remains responsible for the accuracy and legality of information they provide.
Legal policies, disclaimers, terms, medical claims, financial claims and regulated-industry copy should be reviewed by an appropriate professional where required. Website implementation is not a substitute for legal advice.
6. Domains, hosting & third-party services
Domains, hosting platforms, payment processors, analytics tools, social networks, advertising platforms, plugins, APIs and other third-party services are controlled by their respective providers. Availability, pricing, policies and technical behaviour can change without notice.
Where a third-party service is required for a project, the client may need to create or maintain the relevant account and pay the provider directly. Web Zesta is not responsible for outages, policy changes or failures caused by a third-party provider.
7. Launch, maintenance & support
Launch occurs after the agreed deliverables have been reviewed and approved. Post-launch changes, maintenance or support are included only where stated in the selected package or maintenance arrangement.
For websites hosted through a third-party platform, continued operation may depend on the platform account remaining active and properly configured.
8. Intellectual property
Subject to payment and any project-specific agreement, the client receives the agreed rights to the final deliverables created specifically for the project. Third-party fonts, libraries, plugins, stock assets, templates or software remain subject to their own licences.
Web Zesta may retain rights in reusable methods, generic components, know-how and tools that are not unique to the client's brand or confidential materials.
9. Confidentiality
Both parties should treat genuinely confidential business information shared for a project with reasonable care and should not intentionally disclose it except where required to perform the agreed work or comply with law.
10. Cancellation & pause
If a project is cancelled or paused after work has started, fees for work already completed and approved third-party costs may remain payable. Any refund, credit or rescheduling arrangement will depend on the project agreement and work already performed.
11. Limitation of responsibility
Web Zesta aims to deliver the agreed work with reasonable care. We do not guarantee specific business results, search rankings, social media reach, leads, sales, conversions or revenue because these outcomes depend on factors outside our control.
We are not responsible for losses caused by inaccurate client information, third-party outages, account restrictions, changes to external platforms, or use of the website outside the agreed scope.
12. Changes to these terms
We may update these general terms as our services or business practices change. The latest version will be published on this page. Existing projects continue to be governed by the terms agreed for that project where those terms differ.
13. Questions & project-specific terms
If you have questions about these terms or need a project-specific agreement, contact Web Zesta through the Contact page before work begins. These general terms are intended to clarify expectations and are not a substitute for a negotiated contract where one is appropriate.
